Public consultation on the Droit de Suite/Resale Right Directive

June 6 update:

In October 2011, the Commission will report on the implementation and effects of the Resale Right Directive. It is currently conducting a public consultation to address
a wide range of questions relating to the implementation of this Directive, including: the impact of the Directive on the internal market, on the competitiveness of the EU market in modern and contemporary art, on the effect of the introduction of the resale right in those Member States that did not apply the resale right in national law prior to the entry into force of the Directive1, and on the fostering of artistic creativity.

(1.Some Member States benefit from an exemption to apply the resale right to the
works of deceased artists which expires on 1 January 2012. Trade in works subject to the hereditary resale right is four times greater than trade in works by living
artists. In these circumstances, the Commission's report will be prospective in
nature)
